Terms of Service
These Terms of Service (hereinafter referred to as the "Terms") set forth the conditions for use of the service "MochiTube" (hereinafter referred to as the "Service") provided by Kazuki Nishimura (hereinafter referred to as the "Operator"). By using the Service, users are deemed to have agreed to these Terms.
Article 1 (Application)
1. These Terms shall apply to all relationships between users and the Operator regarding the use of the Service.
2. Various rules, guidelines, and other regulations posted by the Operator on the Service shall also constitute part of these Terms.
Article 2 (Account Registration)
1. Some features of the Service may be available without account registration, but authentication via Google Login or similar is required for paid plan usage.
2. The Operator may refuse account creation or suspend/delete accounts without prior notice if it determines that a user falls under any of the following:
- Has violated or is likely to violate these Terms
- The Operator otherwise deems usage inappropriate
Article 3 (Usage Fees and Payment)
1. Users shall pay the usage fees determined by the Operator when using the paid plans of the Service.
2. Payments are processed through the payment system provided by Stripe, Inc. Any disputes related to payments shall be resolved between the user and the payment processor.
Article 4 (Refunds)
1. Due to the nature of the Service, usage fees once paid will not be refunded for any reason.
2. Except in cases of the Operator's willful misconduct or gross negligence, we cannot accommodate refund requests due to the following reasons for service interruption, suspension, or defects:
- Specification changes, defects, maintenance, or suspension of external AI (OpenAI, etc.) and YouTube
- Server, network, or infrastructure failures
- Issues caused by the user's device or network environment
Article 5 (Intellectual Property Rights)
1. Intellectual property rights for all programs, images, logos, trademarks, text, and other materials constituting the Service belong to the Operator or their rightful owners.
2. Users may not reproduce, repost, modify, or reuse such information without prior consent from the Operator.
Article 6 (Prohibited Activities)
Users shall not engage in the following activities when using the Service:
- Placing excessive load on the Operator's or third parties' servers (including scraping and bot usage)
- Reverse engineering, decompiling, analyzing, or modifying the Service
- Using paid plan features for free through unauthorized means or circumventing restrictions
- Unauthorized use of others' YouTube or Google accounts
- Activities that are against public order and morals, or related to criminal activities
Article 7 (Exclusion of Anti-Social Forces)
1. Users represent and warrant that they are not and will not be members of anti-social forces such as organized crime groups. If this is violated, the Operator may immediately suspend the provision of the Service.
Article 8 (Disclaimer)
1. The Operator makes no guarantees regarding the accuracy, truthfulness, timeliness, morality, or appropriateness of the Service's responses (AI-generated summaries, translations, chats, etc.).
2. The Operator does not guarantee that the Service complies with YouTube's Terms of Service, and shall bear no responsibility even if use of the Service results in restrictions, suspension, or other disadvantages to the user's YouTube account.
3. The Operator shall not be liable for any damages suffered by users in connection with the use of the Service.
Article 9 (Service Changes and Suspension)
1. The Operator may suspend all or part of the Service without prior notice to users if there are unavoidable circumstances such as system maintenance, inspection, or suspension of AI APIs.
Article 10 (Amendments to Terms)
1. The Operator may amend these Terms at any time, and the amended Terms shall take effect from the time they are posted on the Service.
Article 11 (Governing Law and Jurisdiction)
1. These Terms shall be governed by and construed in accordance with the laws of Japan.
2. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the Operator's location as the court of first instance.
